Welcome to tanwei.com.sg (the “Website”). The Website is operated by Tan Wei Auto Pte. Ltd., trading as Tan Wei Motorcycles. Certain products or services displayed on the Website may be supplied by Tan Wei Auto Pte. Ltd., Tan Wei Credit Pte. Ltd., or another Tan Wei-affiliated entity identified in the relevant quotation, order form, invoice, financing document or other agreement (collectively, “Tan Wei”, “we”, “us” or “our”).
These Terms and Conditions of Website Use (the “Terms”) govern your access to and use of the Website, including its motorcycle listings, financing calculator, appointment requests, loan pre-approval enquiries, contact forms, articles and other online features.
By accessing or using the Website, you agree to these Terms. If you do not agree, please do not use the Website.
1. Scope of these Terms
1.1 These Terms apply to your use of the Website. They do not, by themselves, constitute an agreement for the purchase, sale, financing, insurance, trade-in, servicing, repair, reservation or delivery of any motorcycle, product or service.
1.2 A transaction with Tan Wei will be governed by the applicable quotation, order form, deposit receipt, hire-purchase or financing agreement, insurance documentation, warranty terms, service booking terms, promotion terms and/or other written agreement provided for that transaction (“Transaction Documents”).
1.3 If there is any inconsistency between these Terms and a Transaction Document, the Transaction Document will prevail in relation to that transaction, except where applicable law provides otherwise.
1.4 Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified, including applicable consumer rights under Singapore law.
2. Eligibility and responsible use
2.1 You may browse the Website at any age. However, you must be at least 18 years old and have legal capacity to submit a financing application, place a reservation or enter into a binding transaction, unless the applicable law and Transaction Documents permit otherwise.
2.2 If you use the Website on behalf of a company or another person, you represent that you are authorised to do so.
2.3 You must provide information that is accurate, complete and current when submitting any enquiry, appointment request, valuation request, account registration or application.
3. Motorcycle listings and Website information
3.1 We aim to keep the Website accurate and up to date. However, motorcycle availability, prices, promotional offers, specifications, colours, accessories, registration dates, mileage, COE information, descriptions, photographs and other details may change or may contain an inadvertent error.
3.2 A motorcycle shown as “available” may be under discussion, reserved or sold before the Website is updated. Displaying a motorcycle on the Website does not guarantee its availability or create an obligation on us to sell it.
3.3 Photographs and videos are for general illustration. Lighting, screens, camera settings, modifications, accessories and the motorcycle’s condition may cause the actual motorcycle to differ from what is displayed. For a pre-owned motorcycle, reasonable wear, previous repairs, replacement parts or cosmetic differences may exist. You should inspect the motorcycle and confirm all material details before entering into a transaction.
3.4 General descriptions, articles, rider guides and comparisons are provided for information only. They are not technical, safety, legal, financial or insurance advice. You remain responsible for checking whether a motorcycle, licence class, product or service is suitable for your needs and lawful use.
3.5 We may correct an error, update information or withdraw a listing or offer at any time before a binding Transaction Document is entered into. If an error affects a transaction already entered into, we will address it in accordance with the Transaction Documents and applicable law.
4. Prices, COE and other charges
4.1 All prices are stated in Singapore dollars unless indicated otherwise.
4.2 The items included in or excluded from a displayed price will be as stated in the relevant listing, promotion, quotation or Transaction Document. Depending on the transaction, the final amount may be affected by COE or Prevailing Quota Premium, registration fees, road tax, insurance, financing costs, optional accessories, administrative charges and other applicable fees or taxes.
4.3 Where a price is described as “from”, “estimated”, “monthly”, “promotional” or subject to prevailing COE or other conditions, it is indicative only and the applicable conditions must be satisfied.
4.4 COE, Prevailing Quota Premium, interest rates, insurer premiums and charges imposed by government agencies or third-party providers may change. The final price and inclusions will be confirmed in writing before you enter into the relevant transaction.
5. Appointments, enquiries and reservations
5.1 An appointment, contact or enquiry form is a request only. It is confirmed only when we notify you that it has been accepted.
5.2 Submitting an enquiry, requesting a viewing or obtaining an indicative quotation does not reserve a motorcycle or require either party to proceed with a transaction.
5.3 A motorcycle is reserved only when the reservation requirements communicated by us have been met and we issue written confirmation. Any reservation period, conditions, deposit treatment and cancellation rights will be stated in the relevant Transaction Documents.
6. Deposits, orders and purchases
6.1 Before collecting a deposit for a motor vehicle sale, we will provide the information required under applicable Singapore law. The amount, purpose, conditions, treatment and any refund rights relating to a deposit will be stated in the relevant written document.
6.2 A payment or deposit does not create rights beyond those set out in the applicable Transaction Documents and applicable law.
6.3 No online communication, automated acknowledgement or Website status constitutes final acceptance of an order unless we expressly confirm acceptance in writing through an authorised representative.
6.4 Any cancellation, refund or transfer request will be assessed under the applicable Transaction Documents and Singapore law. Nothing on the Website should be understood as imposing a blanket “non-refundable” term where the law provides otherwise.
7. Financing, loan pre-approval and insurance
7.1 Any instalment or financing calculator on the Website provides an estimate only. Actual loan amount, downpayment, interest, tenure, instalments, fees and total repayment may differ.
7.2 A loan pre-approval enquiry is not an approval, offer of credit or guarantee that financing will be granted. All financing is subject to eligibility checks, supporting documents, credit assessment, the financier’s approval and the final financing agreement.
7.3 Interest rates and financing promotions may be subject to change, motorcycle eligibility, minimum or maximum tenure, downpayment requirements, COE expiry, customer profile and other stated conditions.
7.4 Insurance information and estimates are general in nature. Coverage, exclusions, premiums and acceptance are determined by the relevant insurer and policy documents.
7.5 You should review the complete financing and insurance documents, understand the total cost and obligations, and seek independent advice where appropriate before committing.
8. Trade-ins and motorcycle valuations
8.1 Any online or preliminary valuation is indicative and is not a binding offer.
8.2 A final trade-in or purchase offer may depend on physical inspection, ownership and registration records, financing settlement, accident and repair history, mileage, modifications, market conditions and any other relevant information.
8.3 You must disclose material information about the motorcycle and must have the legal right and authority to sell or trade it in.
8.4 We may revise or withdraw a valuation if information is incomplete or inaccurate, the motorcycle’s condition differs from what was represented, or relevant circumstances change before completion.
9. Promotions, rewards and benefits
9.1 Promotions, contests, lucky draws, vouchers, member benefits and rewards may be governed by separate terms. Those specific terms will apply in addition to these Terms.
9.2 Unless stated otherwise, promotions and benefits are subject to availability, eligibility, stated validity periods and any redemption limits. They are not exchangeable for cash and may not be combined with other offers.
9.3 We may amend, suspend or end a promotion where reasonably necessary, subject to applicable law and any rights already accrued.
10. Warranties and after-sales services
10.1 Any manufacturer, dealer, workshop or third-party warranty is governed by its specific written warranty terms, including its coverage, period, exclusions and claim process.
10.2 References on the Website to inspections, checks, servicing, warranty or motorcycle condition do not create an additional warranty unless expressly stated in the applicable Transaction Documents.
10.3 Third-party products and services, including warranties, insurance, accessories and workshop services, may be supplied or administered by another entity. The identity of the provider and the applicable terms will be stated in the relevant documentation.
10.4 Nothing in these Terms limits any statutory guarantee, remedy or other right that you may have under applicable Singapore law.
11. Accounts and security
11.1 If the Website allows you to create an account, you are responsible for keeping your login credentials confidential and for activity carried out through your account.
11.2 You must notify us promptly if you believe your account or information has been accessed or used without authorisation.
11.3 We may suspend or restrict an account where reasonably necessary to protect users, prevent misuse, comply with law or investigate a suspected breach.
12. Acceptable use
You must not:
(a) use the Website unlawfully, fraudulently or in a way that infringes another person’s rights;
(b) submit false, misleading, harmful or unauthorised information;
(c) attempt to gain unauthorised access to the Website, an account, server, database or network;
(d) introduce malware, malicious code or any material designed to disrupt the Website;
(e) scrape, copy, harvest, crawl or use automated tools to extract Website content or personal data without our prior written permission, except as permitted by law;
(f) interfere with the Website’s operation or place an unreasonable load on its systems; or
(g) reproduce, modify, distribute, commercially exploit or create derivative works from Website content except as permitted by these Terms or applicable law.
13. Intellectual property
13.1 Unless otherwise stated, the Website and its content, including text, photographs, videos, graphics, logos, layout, software and databases, are owned by or licensed to Tan Wei and are protected by applicable intellectual property laws.
13.2 You may view and make a limited personal copy of Website content for your own non-commercial use. No other licence or right is granted.
13.3 Brand names, model names, logos and trademarks belonging to motorcycle manufacturers or other partners remain the property of their respective owners. Their appearance on the Website does not grant you any right to use them.
14. User submissions
14.1 If you send us a review, photograph, video, suggestion, feedback or other content, you confirm that you have the right to submit it and that it is not unlawful, misleading, defamatory or infringing.
14.2 Unless we agree otherwise, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and adapt that submission only for responding to you, providing the requested service, operating our business or marketing Tan Wei. Our handling of personal data remains subject to our Privacy Policy / Statement and applicable law.
14.3 We are not required to publish or retain any submission and may remove content where reasonably necessary.
15. Third-party websites and services
15.1 The Website may link to WhatsApp, social media platforms, map services, payment providers, financiers, insurers, manufacturers, workshops and other third-party websites or services.
15.2 We do not control third-party websites or services and are not responsible for their availability, security, content or practices. Your use of them is subject to their own terms and privacy policies.
15.3 A link or reference does not necessarily mean that we endorse every statement, product or service offered by the third party.
16. Personal data and cookies
16.1 Our collection, use, disclosure and protection of personal data are governed by our Privacy Policy / Statement, available on the Website, and applicable Singapore data protection law.
16.2 The Website may use necessary cookies and similar technologies for functionality, security and user experience, and other cookies where permitted or consented to. Please refer to our Privacy Policy / Statement and any cookie notice displayed on the Website.
17. Website availability and cybersecurity
17.1 We may update, suspend, withdraw or restrict all or part of the Website for maintenance, security, operational or other reasonable purposes.
17.2 We do not guarantee that the Website will always be available, uninterrupted, error-free or free from harmful code. You should use appropriate device, browser and cybersecurity protections.
17.3 You are responsible for your own internet connection, device and any charges incurred when accessing the Website.
18. Liability
18.1 The Website is provided on an “as available” basis. To the maximum extent permitted by law, we do not make warranties about uninterrupted access or the completeness and accuracy of general Website content, except for express commitments in a binding Transaction Document.
18.2 To the maximum extent permitted by law, Tan Wei will not be liable for indirect, incidental, special or consequential loss arising solely from your use of, or inability to use, the Website, where such exclusion is reasonable and lawful.
18.3 We are not responsible for loss caused by events outside our reasonable control, third-party websites or services, your inaccurate information, your breach of these Terms, or unauthorised account access caused by your failure to protect your credentials.
18.4 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, wilful misconduct, or any other liability that cannot lawfully be excluded or limited.
18.5 This section does not reduce any rights or remedies you may have under the Consumer Protection (Fair Trading) Act 2003 or other applicable law.
19. Suspension and termination
19.1 We may suspend, restrict or terminate your access to the Website if you materially breach these Terms, misuse the Website, create a security risk or if we are required to do so by law.
19.2 Terms which by their nature should continue after termination, including provisions on intellectual property, liability and governing law, will remain in effect.
20. Changes to these Terms
20.1 We may update these Terms from time to time to reflect changes to the Website, our services, business practices or applicable requirements.
20.2 The revised Terms will be posted on this page with a new “Last updated” date. Changes will apply from the stated effective date and will not retrospectively alter an existing Transaction Document unless permitted by that document and applicable law.
21. General
21.1 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.
21.2 A failure or delay in exercising a right under these Terms is not a waiver of that right.
21.3 You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations as part of a genuine business transfer or restructuring, provided this does not reduce any non-excludable rights you have under applicable law.
21.4 A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 2001 to enforce any provision of these Terms.
22. Governing law and disputes
