Before we proceed, we wish to highlight that your privacy is as important and paramount to us as it is to you. Accordingly, our business is conducted in compliance with the Personal Data Protection Act 2012 (“PDPA”) and it is our priority that your privacy and personal data are protected in an open and transparent manner and in compliance with the PDPA, by the implementation of the relevant measures and policies. 

Do take the time to go through the Privacy Policy / Statement herein to understand how your personal data is collected, utilised, shared and protected. 

This Privacy Statement will set out the measures and policies of Tan Wei Auto Pte Ltd and its affiliated company, Tan Wei Credit Pte Ltd (collectively the “Tan Wei Companies”, “we” or “us”) relating to how we collect, utilise, store and/or disclose your personal data that may be collected by us on this website and any other website maintained by the Tan Wei Companies, any and all other social media applications / platforms operated by us (for instance, our Facebook, Instagram or TikTok pages) as well as at our showrooms and at all physically held and convened events (collectively, the “Platforms”). 

By using the Platforms or our product and service offerings (which would include any and all submissions of your or other third parties’ personal data to us), you agree and consent that we may collect, utilise, store and/or disclose such personal data pursuant to the terms of this Privacy Policy / Statement herein and/or as permitted or required by the PDPA and/or any other law or statute. 

Should you not be agreeable to any of the terms of this Privacy Policy / Statement, please do NOT utilise the Platforms, our product and service offerings or otherwise submit or provide any of your or other third parties’ personal data to us. In such a case, take further notice that we will not be able to provide certain product and services offerings to you. 

PERSONAL DATA

For the purposes of this Privacy Policy / Statement, “personal data” is defined as data (the veracity and/or accuracy of which being irrelevant) about an individual who can be identified from that data, or from such said data and other information to which we have or is likely to have access to. 

In utilising the Platforms and/or our product and service offerings, a non-exhaustive list of such personal data includes but is not limited to:-

  1. personal particulars (e.g. name, contact details such as email addresses and mobile phone numbers, residential addresses, date of birth, identity card/passport details, and/or education details);
  2. signature(s) (including but not limited to digital forms of signatures);
  3. financial and/or employment related details and information (e.g. income, salary, occupation, CPF, credit details);
  4. banking details and information (e.g. bank account numbers, credit / debit card numbers);
  5. vehicle details and information (e.g. make and model, registration date, chassis and engine numbers, license plate numbers, ERP IU unit numbers); and
  6. non-personally identifiable details and information (e.g. demographical information such as age, gender, interests, habits, activities as well as feedback provided and surveys completed on the Platforms as well as internet IP addresses, geographical location, cookies and any and all other electronic forms of data) provided and/or submitted to us in connection with your utilisation of the Platforms and/or our product and services offerings.

PURPOSES OF COLLECTION AND UTILISATION OF YOUR PERSONAL DATA

We may collect personal data from you via our Platforms and through the utilisation of our product and service offerings (and in all connections thereof). In all such instances, the extent of such collection and utilisation of such said personal data will be pursuant to the PDPA and other relevant laws / statues as well as where we have obtained your express agreement and consent (where required by the PDPA or other relevant laws / statutes). 

A general list of instances where your personal data is collected is as follows:

  1. in purchasing and/or hiring a product from us or when you utilise any of our service offerings or when you enter into any form of transaction(s) with us;
  2. opening an online personal account on any and all of our Platforms (where applicable) to access a certain range of our product and service offerings;
  3. booking or making a prior appointment to meet with us and/or to visit our showrooms to view our product and service offerings;
  4. making general enquiries to us in respect of our product and service offerings;
  5. signing up to and/or subscribing to our electronic newsletter(s);
  6. completing any survey forms or questionnaires; and
  7. participating in our events, promotions, contests, give-aways activities or roadshows.

The extent of the utilisation of such said collected personal data will be pursuant to the PDPA and other relevant laws / statues as well as where we have obtained your express agreement and consent (where required by the PDPA or other relevant laws / statutes). 

A general list of the purposes of the utilisation of the collected personal data are as follows: 

(a) to conduct our business with you which includes your purchase / hiring of our products and the provision of our service offerings to you (which encompasses but is not limited to the processing of payments and transactions);

(b)  to communicate and/or to contact you in respect of our business with you and/or transactions with you and to follow up with your enquiries and/or requests to us;

(c) to facilitate your participation in any of our events, promotions, contests, give-aways activities or roadshows;

(d) to obtain an understanding of your preferences in respect of our product and service offerings and to provide suggestions and/or recommendations as well as to continually refresh or update our product and service offerings in view of such preferences;

(d) to maintain the records (which includes but is not limited to our customers’ records) pertaining to our businesses; 

(e) to conduct our internal staff training and development;

(f) to safeguard against any misuse or unauthorised usage of our Platforms and to take all reasonable measures in connection with the same;

(g) to send or otherwise circulate to you information relating to our product and service offerings including our events, promotions, contests, give-aways activities or roadshows and where you have provided your express consent to us to do so; 

(h) for any other purpose for which the relevant personal data was submitted to / provided to us, and for any and all other purposes to which you had provided your express consent to us to do so, and for the purposes pursuant to the requirements of the PDPA and/or any other laws / statute;

(i) to comply with any and all applicable laws, statutes, regulations, codes, guidelines or rules, or to assist in law enforcement and investigations conducted by any governmental and/or regulatory authority; and

(j) to transmit to any unaffiliated third parties including our third-party service providers and agents, and relevant governmental and/or regulatory authorities, whether in Singapore or overseas, for the aforementioned purposes. 

Our electronic based Platforms (i.e. our websites and social media accounts / pages) are generally accessible without the need for you to submit any personal data to us. Do take notice however, that some of our product and service offerings may not be available to you should the requisite personal data not be provided. 

DISCLOSURE OF PERSONAL DATA AND INFORMATION SHARING

The extent of the disclosure and/or sharing of such said personal data will be pursuant to the PDPA and other relevant laws / statues

We may disclose and/or share your personal data:

  1. where such disclosure is required for performing obligations in the course of or in connection with our provision of our product and service offerings to you;
  2. to our third-party service providers, agents and other organisations we have engaged to perform services for us and/or on our behalf and in such instances, the extent of disclosure here will only be limited to the aspects of the personal data (or parts thereof) in which our third-party service providers, agents and other organisations which we have engaged would require to perform and/or deliver their services to us and/or on our behalf;
  3. to our affiliates who may be required to deliver / perform certain services for us in respect of the product and/or service offerings to you, the extent of disclosure here will only be limited to the aspects of the personal data (or parts thereof) in which our affiliates would require to perform and/or deliver the relevant services and that there will be an arrangement between us and our affiliates which prohibits the latter from disclosing or otherwise utilising the aspects of the personal data (or parts thereof) other than for the purposes in which it was disclosed to them; 
  4. to financial institutions / insurance companies providing financing and/or insurance products and services which are ancillary to our product and service offerings and in which you have agreed to apply for such said financing and/or insurance products or services;
  5. to governmental and/or regulatory authorities or law enforcement bodies when such requests are made to us; 
  6. to safeguard against any misuse or unauthorised usage of our Platforms and to take all reasonable measures in connection with the same; and
  7. to any other entity, organisation and/or person for any other purpose to which you have provided your consent and/or as required under any and all laws, statutes, regulations, codes, guidelines or rules.

STORAGE OF PERSONAL DATA

The collected personal data would usually be stored or processed on our servers in Singapore but may also be stored or processed outside Singapore. In the event that such collected personal data is stored or processed outside Singapore, we will ensure that such foreign service providers we engage observe strict confidentiality and data protection obligations and, in any event, to a standard no less stringent than that under the PDPA. 

WITHDRAWING YOUR CONSENT

The consent that you provide for the collection and utilisation of your personal data will remain valid until such time it is being withdrawn by you in writing. You may withdraw consent and request us to stop using and/or disclosing your personal data for any or all of the purposes listed above by submitting your request in writing or via email to our Data Protection Officer at Asktwm@tanweiauto.com.

Upon receipt of your written request to withdraw your consent, we may require reasonable time (depending on the complexity of the request and its impact on our relationship with you) for your request to be processed and for us to notify you of the consequences of us acceding to the same, including any legal consequences which may affect your rights and liabilities to us.

YOUR CONTACT PREFERENCES FOR MARKETING MATERIAL

Where your email addresses or mobile phone numbers have been provided to us and you have consented to us sending or circulating marketing material to you, such material may be sent or circulated via the mediums of emails, short messaging service (“SMS”), multimedia messaging service (“MMS”) or other messaging mediums (e.g. WhatsApp or Telegram). 

In the event that you do not wish to receive such marketing materials, you may unsubscribe to the same by selecting and/or indicating your preference as provided in any such email, SMS, MMS or messages on other messaging mediums. 

You may still continue to receive non-marketing messages permitted under the applicable laws / statutes. 

PROTECTING PERSONAL DATA

We endeavour to take protect your personal data against unauthorised or unintended access, usage or disclosure. 

A brief summary of our security measures in protecting your personal data is as follows:

  1. restriction of our internal staff access to any confidential documents that may contain your personal data and only to be accessed for the strictly for the purposes set out above in this Privacy Policy / Statement;
  2. our staff will be bound by confidentiality agreements / clauses in their employee relationship with us; and
  3. installation, maintenance and updating of the relevant and adequate computer security software and/or hardware (where applicable). 

For any online personal user accounts that you may sign up on our Platforms (in particular, that relating to our websites), do keep all user information and passwords secure and not share this with any other party. It shall be your sole responsibility to ensure that such information is kept secure and we shall not be liable for any unauthorised access to shall accounts should this be a result of your failure to secure such information. 

 While we make every reasonable effort to protect your personal data, please be informed that it is not practicable to and we do not warrant or guarantee that data transmitted via the internet is wholly protected and/or secure. 

As such, we shall not be liable or responsible for any unauthorised or unintended access, usage or disclosure of your personal data that is beyond our reasonable control. 

For the avoidance of doubt, and to the maximum permissible extent under the law, we shall not be liable in any event for any damages of whatever type or kind and/or for any loss of reputation or goodwill and whether such is based or premised upon contract, tort (including negligence), equity, strict liability, statutory or otherwise, suffered as a result of unauthorised or unintended access, usage or disclosure of your personal data.  

ACCESS AND CORRECTION OF PERSONAL DATA

If you wish to make:

  1. an access request for access to a copy of the personal data which we hold about you or information about the wats in which we utilise or disclose your personal data; or
  2. a correction request to correct or update any of your personal data which we hold about you,

you may submit your request via email to our Data Protection Officer at Asktwm@tanweiauto.com.

Please note that a reasonable fee may be charged for an access request. If so, we will inform you of the fee before processing your request. 

We will respond to your request as soon as reasonably possible. Should we not be able to respond to your request within 30 days after receiving your request, we will inform you in writing within 30 days of the time by which we will be able to respond to your request. If we are unable to provide you with any personal data or to make a correction requested by you, we shall generally inform you of the reasons why we are unable to do so (except where we are not required to do so under the PDPA). 

RETENTION OF PERSONAL DATA

We may retain your personal data for as long as it is necessary to fulfil the purpose for which it was collected, or as required or permitted by applicable laws / statutes.

We will cease to retain your personal data, or remove the means by which the data can be associated with you, as soon as it is reasonable to assume that such retention no longer serves the purpose for which the personal data was collected, and is no longer necessary for legal or business purposes.

THIRD-PARTY / OTHER WEBSITES 

The Privacy Policy / Statement herein is not extended to any other third-party or other websites (which may be broadcasted in our websites). We do not have any control to such said third-party or other websites. It is therefore suggested that you obtain and review the privacy statements and/or policies of such said websites before disclosing any personal data to such entities. 

AMENDMENTS AND NOTICE OF CHANGES

This Privacy Policy / Statement applies in conjunction with any other notices, contractual clauses and consent clauses that apply in relation to the collection, use and disclosure of your personal data by us.

We may revise this Privacy Policy / Statement from time to time without any prior notice. You may determine if any such revision has taken place by referring to the date on which this Privacy Policy / Statement was last updated. Your continued use of our Platforms and/or our product and service offerings constitutes your acknowledgement and acceptance of such changes.
